Kelly's lawyer spilled the beans to People magazine, stating that the current incarceration situation is a "cruel and unusual punishment" under these circumstances. The motion alleges that three Bureau of Prisons officials colluded to order the inmate to take Kelly out. The court records even include a statement from this inmate, who claims high-ranking officials in the U.S. prison in Tucson (Arizona) asked him to carry out the murder.

This inmate, a long-time member of the notorious Aryan Brotherhood, was reportedly tasked with ordering attacks, beatings, and killings of inmates. With his authority to command beatings, stabbings, and executions by other gang members, he was asked to kill R. Kelly after receiving the order.

Upon arrival at the Federal Correctional Institution in Butner, North Carolina, where Kelly is also serving his sentence, a guard allegedly approached him and said, "You must do what you were brought here to do." He was promised freedom upon completion of the task, making it a tempting offer, given his terminal cancer diagnosis at the time.

Despite these convictions, Kelly continues to deny all allegations, with multiple appeals turning down.
