Access to coastline: Notification under Section 52 issued for the stretch from Kimmeridge Bay to Highcliffe

The Secretary of State for Environment, Food and Rural Affairs has approved proposals for improving coastal access between Kimmeridge Bay and Highcliffe, as stated in a notice issued on April 6, 2022. This decision was granted by Dorset Council and is in accordance with the Marine and Coastal Access Act 2009.

The coastal access improvements were first proposed by Natural England in a report submitted back in 2017. The report outlined the proposed enhancements, which aim to provide greater public access to this beautiful stretch of coastline.

However, there is a pending issue regarding Chapter 6 of the report. Due to a High Court Order, the status of this chapter is under review. The decision about the implementation of Chapter 6 is yet to be determined, and the future of this part of the coastal access improvements remains uncertain.

The approval of Chapter 6 in the coastal access report has been challenged in court. As a result, the Secretary of State has consented to the quashing of the decision to approve Chapter 6. The legal proceedings concerning this matter are ongoing.

The current situation with Chapter 6 is that it is in a state of legal review. The status of the coastal access improvements proposed in Chapter 6 is currently undetermined.

Meanwhile, the coastal access improvements between Kimmeridge Bay and Highcliffe, excluding Chapter 6, have received the green light. The public can look forward to enjoying improved access to this scenic part of the coastline in the near future.

It is important to note that the approval of the coastal access improvements does not affect the ongoing legal review of Chapter 6. The future of this part of the improvements will be determined by the outcome of the ongoing legal proceedings.
